This Data Privacy Declaration shall apply to Internet information services offered by the Academy of Fine Arts Vienna, which are accessible at the domain akbild.ac.at and its subdomains (hereinafter referred to as “our web presence” or “Internet presence”).

3. General information on data processing
3.1. Personal data
Personal data are individual items of information relating to the personal or factual circumstances of an identified or identifiable natural person (data subject). This includes, for example, information about your name, postal address, phone number, date of birth, or e-mail address. Information that cannot be related to an individual person (or where this would take a disproportionate effort), e.g. anonymized information, are not personal data.
3.2. Extent
As a rule, we collect and use personal data of our users only to the extent in which this is necessary for the functionality of our website and the provision of our contents and services. We use your personal data to make available information offered by us and services requested, to answer your questions, as well as for the operation and improvement of our websites and applications. The collection and use of personal data of our users is only done on the basis of the law in accordance with the GDPR, e.g. after obtaining the consent of the user.
Any further processing of your personal data will not occur. There will be not transfer of your personal data to any third party nor any use of your personal data for advertising purposes without your prior consent unless we are under legal obligation to make such transfer.
3.3. Legal basis
To the extent that we obtain the consent of the data subject for the processing of personal data, Art. 6 para. 1 lit. a EU GDPR serves as the legal basis. In the processing of personal data required for the performance of a contract to which the data subject is a party, the legal basis is Art. 6 para. 1 lit. b EU GDPR. This also applies to processing operations that are necessary to carry out pre-contractual measures. To the extent that the processing of personal data is required to fulfil a legal obligation to which the Academy of Fine Art Vienna is subject, the legal basis is by Art. 6 para. 1 lit. c EU GDPR.
In the event that the vital interests of the data subject or another natural person require the processing of personal data, the legal basis is provided by Article 6 para. 1 lit. d EU GDPR. If the processing is necessary for the purposes of the legitimate interests pursued by the Academy of Fine Arts Vienna or by a third party and if said interest is not overridden by the interests or fundamental rights and freedoms of the data subject, Article 6 para. 1 lit. f EU GDPR serves as the legal basis of such processing.
3.4. Erasure of data and storage period
Personal data of the data subject will be erased or blocked as soon as the purpose of storage ceases to apply. In addition, data storage may also occur if so provided for by European or national legislators in EU regulations, laws or other provisions to which the data controller is subject. Data will also be blocked or erased upon expiry of a storage period prescribed by any such provision, unless there is a need for further storage of the data for the conclusion or performance of a contract.
